WHERE ARE THE LAWS?
Laws are already in force in:
- Germany: “Lieferkettensorgfaltspflichtengesetz” (German Supply Chain Act)
- France: “Le Devoir de Vigilance” (Law on Duty of Vigilance)
- The Netherlands: “Wet Zorgplicht Kinderarbeid” (Child Labour Due Diligence Law)
- UK: “The modern Slavery act”
- Norway: “The transparency act”
An EU HREDD Directive is also currently being finalised. When in force it will impact all countries.




WHAT THE LAWS SAY
The laws in place require that companies apply due diligence processes at every stage of their supply chain to ensure that they identify potential risks with regards to human rights and environmental impacts and take appropriate steps to prevent, mitigate or remediate any negative effects.
COMPANIES SELLING PRODUCTS IN EUROPE NEED TO COMPLY
The scope of the different local laws may differ slightly, but in general they concern (in the first instance) large EU companies or non-EU companies selling in Europe.
THE RISKS OF NON-COMPLIANCE

FINANCIAL RISKS
Fines can amount to up €8 million or up to 2% of a company's worldwide annual turnover

Civil Liability Risks
Member States will be able to ensure that victims get compensation for damages resulting from the failure to comply with their obligations.

REPUTATIONAL RISKS
HREDD is not only a legal requirement but also a moral consideration for companies who are committed to responsible business practices. Compliance helps to build and maintain trust with their stakeholders, including employees, investors, customers, and civil society.

B&C has developed its due diligence procedure according to the UN Guiding Principles on Business and Human Rights. We thereby ensure that all the necessary steps towards being HREDD compliant are followed at all times, throughout our supply chain.

Our risk assessment analysis has enabled us to identify and prioritise key risks related to the environment (E), social issues (S), and governance (G) that may arise across our supply chain.

Our HREDD policies are designed to identify and mitigate any possible adverse impacts on human rights and the environment that could result from our actions or those of our suppliers.




Memberships & Certifications
Our memberships of associations such as FWF and amfori BSCI mean that we are supported in our Human Rights Due Diligence. Certifications support us in limiting our environmental impacts.
Constant Monitoring
As a business we constantly monitor risks at country, factory and product level, and we run audits ourselves and with 3rd parties to make sure we can quickly mitigate or remediate any issues.




Local Team
B&C has a team of 23 people in its main sourcing country (Bangladesh) including our Compliance Manager, who is key in monitoring compliance with all our partner factories.
